Default speeding

okay, i got a speeding fine, the thing that is pissing me off, is the fact that the officers judged me speed whilst stuck behind a car that i had over taken a good 5 km's before my supposed speeding offense.

the officer that fined me admitted to being stuck behind the learner that was sitting well below the speed limit. and was no where near me when they claimed i was speeding.

time..? how much is the fine/points?
do you have occupants/witnesses who can back yr story?

in mt evelyn, last night roughly around 8:40ish.

from what she said it is 4 points.

and their is no witnesses as i was alone traveling to meet up with a friend.

While I can't comment on the actual circumstances, Victoria Police have just got hold of a new radar that can check cars going in the same direction as the police car while both are moving. It has a very good range. Just a possibility.
If the circumstances are such that they claim to have checked you by a maintain even distance, then I would be asking more questions. Have a good read of the ticket. In the bit about 2/3 down and on the left under information, they should have written something like 'ordinary speed check' or 'radar'. That tells you how they obtained the speed. There's also another way using a thing called a TDS. That stands for time, distance, speed. They check the time it took you over a measured distance. The distance in metres multiplied by 3.6 and divided by the time in seconds gives you the average speed over that distance. eg 410 metres x 3.6 divided by 12.6 seconds =117.42 kph.
Without knowing the exact circumstances it's very hard to comment.
You have 4 options.
1. Write a plea letter but if it's for more than 10 kph over don't bother.
2. Request a review in regard the circumstances of the speed check.
3. Object to the ticket and take it to court.
4. Pay the ticket. If you have a health care card you can be eligible for a payment plan if you ring them and request it.
There is a 5th option.
Ignore it and wait until the reminder comes or the Sheriffs.
